Terms of Service
The rules for working with us, written in plain English: what you pay, what’s refundable, and who owns what.
About these terms
These Terms of Service ("Terms") apply when you buy from, or work with, BlueFire Marketing & Consulting Firm, LLC ("BlueFire Marketing," "we," "us"). That includes our websites bluefiremcf.com, bluefirewebsite.com, bluefiresocialmedia.com, bluefirepromos.com, bluefirelogos.com, bluefireprint.com and bluefiredirectmail.com, and any project, product or plan you order from us.
By placing an order, paying an invoice, or checking the box at checkout, you agree to these Terms. If you are ordering for a business, you confirm you are authorized to agree for that business. If a signed proposal or written agreement for your project says something different, that document controls for your project.
Orders, prices and payment
- Prices are in US dollars and are shown on our websites or in your written quote. Sales tax is not charged on our services unless the law requires it.
- Payment is processed securely by Stripe. We never see or store your full card number.
- One-time purchases (such as a website build) are paid in full at checkout. We don’t take deposits.
- Plans and subscriptions (care plans and All-In plans) are billed in advance, monthly or yearly, and renew automatically until cancelled.
- Failed payments. If a renewal payment fails, Stripe will retry it and we will contact you. If it still isn’t paid within 14 days, we may pause the services that plan covers, including hosting, until the account is current.
- Third-party costs, such as your domain name, Shopify or other platform subscriptions, premium plugins, paid stock photos and postage, are paid by you unless your plan or quote says otherwise.
Website builds
- What’s included is listed with each package (Starter, Growth, Commerce) on bluefirewebsite.com or in your quote. Anything outside that scope is quoted separately before we start it.
- Your part. You agree to provide the content we need (text, photos, logo, product details and logins) and to give feedback in a reasonable time. Timelines depend on receiving these.
- Revisions are included as described in your package. Further changes after launch are covered by a care plan or billed at our hourly rate, quoted in advance.
- Hosting is not included with a one-time build. You can host the site yourself or add a care plan, which includes hosting.
- Commerce websites include up to 25 products loaded. Larger catalogs and custom features are quoted separately.
- Results. We build every site to follow search and speed best practices, but no one can guarantee specific rankings, traffic or sales.
Our money-back guarantee and refunds
Website builds (one-time payment): you are covered by a 100% money-back guarantee until you approve your launch. If you aren’t satisfied with your website, tell us before you approve the launch and we will refund the full build price to your original payment method, usually within 10 business days. When a project is refunded, the design and files stay with us and are not used for your business.
Approving your launch means you are satisfied and ready for your website to go live. Once you approve the launch, the project is complete and the build price is no longer refundable.
Logo and brand packages: you are covered by a 100% money-back guarantee until you approve your final logo design. Once you approve it, your files are delivered and the package is no longer refundable. In the Launch package, the website follows the website guarantee above, and the included Spark care plan follows the rules for plans and subscriptions below.
Inactive projects. If we send you your website or logo concepts for review and don’t hear back for 60 days, we will email you a final notice. If you don’t reply within 14 days of that notice, the project is considered complete and approved.
Plans and subscriptions (care plans, hosting and All-In plans) are not refundable, including partial months or years. You can cancel at any time and your plan simply won’t renew.
Disputes. If something isn’t right, please contact us first. We would much rather fix it than have you open a dispute with your bank.
All-In monthly plans
An All-In plan (Starter All-In, Growth All-In or Commerce All-In) spreads the cost of your website build and 12 months of hosting and care over 12 monthly payments. Your first payment is due when you order. There is no setup fee.
- For the first 12 months, your website is leased, not owned. It stays on our servers, and it can’t be moved to another host during that time. Your domain name stays yours and simply points to the site.
- Cancelling during the first 12 months is allowed at any time. Your website goes offline at the end of the period you have paid for, and payments already made are not refundable. You don’t owe the remaining payments.
- After your 12th payment, the website is yours. You can move it to any host you choose (we will provide a copy of your site files or help with the move), or stay with us. If you stay, your plan continues automatically at the matching care plan rate: Spark for Starter, Flame for Growth, Blaze for Commerce.
- The money-back guarantee above applies to All-In plans in the same way: until you approve your launch, you can cancel and we will refund the payments you have made.
Care plans and hosting
- What’s included (hosting, SSL, backups, updates and edit time) is listed with each plan (Spark, Flame, Blaze).
- Edit time resets each billing period and doesn’t roll over. Work beyond your plan’s time is billed at our hourly rate, and we will tell you the cost before starting.
- Cancelling. You can cancel at any time. Your plan stays active until the end of the period you have paid for and then ends, including hosting. If you own your website, ask us for a copy of your files before your plan ends.
- Uptime. We work hard to keep your site online and backed up, but we can’t guarantee uninterrupted service, and outages caused by hosting, network or third-party providers can happen.
- Acceptable use. Sites we host may not contain illegal content, malware, spam or content that infringes someone else’s rights. We may suspend a site that does, and we will tell you why.
Logos, print, promotional products and direct mail
- Online print orders (bluefireprint.com). You upload your own print-ready files. Before printing, we check each file’s size, bleed and image resolution and email you if something would print poorly. We don’t proofread: spelling, phone numbers and other content are your responsibility, and we print your file as supplied. Production time starts once your file is ready to print. You can cancel for a full refund until your order goes to press.
- Your files. You confirm you have the right to print everything in the files you send. We may decline to print content that is illegal or infringes someone else’s rights, and refund the order if we do.
- Proofs. Custom products are made from the proof or design you approve. Please check spelling, colors, sizes and quantities carefully. Once you approve a proof, we produce exactly what it shows.
- Refunds. Because printed and promotional items are made to order, they can’t be returned or refunded after you approve the proof. If an item arrives damaged or doesn’t match the approved proof, tell us within 7 days of delivery and we will reprint or replace it at no charge.
- Colors and quantities. Printed colors can vary slightly from what you see on screen, and print runs can vary slightly in quantity, as is normal in the industry.
- Shipping and timing. Production and delivery times are estimates. We are not responsible for carrier delays.
- Direct mail. Postage and mailing-list costs are paid before mailing and can’t be refunded once the mail has been handed to the post office.
- Logos. Logo packages include the concepts and revisions listed with your package. You own the final logo, with full copyright, once it is paid in full.
- Design files. Stationery, social media and other designs are delivered as finished, print-ready and web-ready files, not as editable design templates.
Who owns what
- Your content (text, photos, logos and other materials you give us) stays yours. You confirm you have the right to use it, and you allow us to use it to complete your project.
- Your website or design becomes yours once it is paid in full. For All-In plans, that is after your 12th payment.
- Third-party items such as themes, plugins, fonts and stock photos are licensed to you under their own terms, not owned by you or by us.
- Our tools and know-how, such as reusable code, templates and methods we use across projects, remain ours, and we may keep using them.
- Portfolio. We may show finished work in our portfolio and marketing. If you would rather we didn’t, just tell us.
Limits of liability
We provide our services with care and skill, but otherwise "as is." To the extent the law allows, BlueFire Marketing & Consulting Firm, LLC is not liable for indirect, incidental or consequential losses, such as lost profits, lost data or lost business, and our total liability for any claim is limited to the amount you paid us for the service involved in the 12 months before the claim.
You agree to cover us against claims that arise from content you provided or from how you use the website or products we deliver.
Governing law
These Terms are governed by the laws of the State of Florida. Any dispute will be handled in the state or federal courts located in Miami-Dade County, Florida, unless we both agree to another way of resolving it.
Changes to these terms
We may update these Terms from time to time. The version posted on this page, with its effective date, applies to new orders. Changes won’t apply retroactively to a project or plan period you have already paid for.
Text messages (SMS terms)
Program. BlueFire Marketing sends text messages to customers and people who request information from us. There are two kinds, and you choose each one separately: account messages (replies to your request, order and project updates, appointment reminders and billing notices) and marketing messages (occasional offers and news).
How you opt in. You agree to receive texts by checking the text message box on one of our forms (such as the free brand audit or a Marketing Tools order), or by texting us first. Checking a box is optional, and consent is not a condition of any purchase.
- Message frequency varies with your request and orders. Marketing messages are sent no more than a few times a month.
- Message and data rates may apply, based on your mobile plan.
- To stop, reply STOP to any message. You’ll get one message confirming you’re unsubscribed, and no more after that. You can opt back in by replying START.
- For help, reply HELP, call (305) 699-6225 or email [email protected].
- Wireless carriers are not liable for delayed or undelivered messages.
We handle your mobile number as described in our Privacy Policy. We never sell or share it with third parties for their marketing.
Texts we send for our clients. When we run text tools for a client’s business (such as review requests, missed-call text-back or appointment reminders), that client is responsible for having their customers’ consent, and every message includes a way to opt out.
